UK digital markets rules now create contractual leverage moments for dependent businesses
Part 1 of the Digital Markets, Competition and Consumers Act 2024 gives the CMA powers to designate firms with strategic market status and impose conduct requirements. The CMA has consulted on proposed conduct requirements for Google’s general search services, signalling expectations around fair dealing, open choices, and transparency. For scaling technology businesses reliant on search, app ecosystems, or advertising inventory, vendor terms, ranking dependencies, and change control provisions should be reviewed in light of compliance-driven product and platform changes.
